1. Agreement to Terms
By downloading, installing or using the Insuq application ("App") or any related services provided by Aftermath Ltd ("Company", "we", "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.
Aftermath Ltd is a company registered in Malta. The Insuq platform provides a digital service connecting driving instructors and learner drivers, supporting theory study, practical lesson tracking, skill assessment, and progress monitoring.
2. Eligibility & Account Registration
You must be at least 16 years of age to create an account. Users under 18 require parental or guardian consent.
Driving instructors must hold a valid ADI (Approved Driving Instructor) licence recognised in Malta or their relevant jurisdiction.
You agree to provide accurate, complete and current information during registration and to keep your account details up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us immediately at support@insuq.com if you suspect unauthorised access to your account.
3. Permitted Use
The Insuq platform is licensed to you for personal, non-commercial use in connection with driving instruction and learner driver education. You may use the App to:
Access and complete theory study modules, quizzes and flashcard sets
Book and manage driving lessons with your registered instructor
Track practical driving progress and skill assessments
Communicate with your instructor via the in-app messaging system
View progress reports, lesson plans and performance analytics
4. Prohibited Conduct
You agree not to:
Use the App for any unlawful purpose or in violation of any applicable law or regulation
Attempt to reverse-engineer, decompile, disassemble or otherwise derive the source code of the App
Use automated bots, scrapers or scripts to access or interact with the App
Misrepresent your identity, qualifications or instructor status
Upload or transmit any content that is unlawful, defamatory, obscene, or infringes the intellectual property rights of any third party
Interfere with or disrupt the integrity or performance of the platform or its infrastructure
Attempt to gain unauthorised access to any part of the platform or its data systems
5. Subscriptions & Payments
Certain features of the Insuq platform require a paid subscription. By subscribing:
You authorise Aftermath Ltd to charge the applicable subscription fee to your chosen payment method on a recurring basis (monthly or annually)
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period
You may cancel your subscription at any time via Settings → Subscription within the App
Refunds are provided in accordance with applicable EU consumer protection law and our Refund Policy
Aftermath Ltd reserves the right to modify pricing with 30 days' prior notice to subscribers
Taxes may apply depending on your jurisdiction and will be displayed at checkout
6. Disclaimer of Warranties
The Insuq platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Aftermath Ltd does not warrant that:
The App will be uninterrupted, error-free or completely secure at all times
Study materials will guarantee success in any theory or practical driving test
Instructor profiles, reviews or credentials are verified beyond what is stated in our verification process
All content is accurate, complete or current at all times
Nothing in these Terms affects your statutory rights as a consumer under Maltese or EU law.
7. Limitation of Liability
To the fullest extent permitted by law, Aftermath Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to:
Loss of data or corruption of data stored on the platform
Failure to pass a driving theory or practical test
Loss of earnings arising from inability to access the platform
Actions or omissions of instructors or students using the platform
Our total aggregate liability in connection with these Terms shall not exceed the amount paid by you to Aftermath Ltd in the 12 months preceding the event giving rise to the claim.
8. Instructor Responsibilities
Instructors are solely responsible for the conduct, safety and legality of driving lessons delivered through the platform
Instructors must maintain a valid ADI licence and adequate insurance throughout their use of the platform
Insuq is a technology platform and is not a party to the instructor-student relationship. Aftermath Ltd accepts no liability for incidents occurring during lessons.
Instructors must accurately record lesson data, skill assessments and student progress on the platform
Instructors must not engage in discriminatory conduct toward any student
9. Intellectual Property
All content within the Insuq platform — including but not limited to software, design, text, images, icons, study materials, quiz questions, logos and the Insuq brand — is the intellectual property of Aftermath Ltd or its licensors and is protected by copyright, trademark and other applicable laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App solely for the purposes described in these Terms. No intellectual property rights are transferred to you.
10. Termination
Aftermath Ltd reserves the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, applicable law, or pose a risk to other users or the platform.
You may close your account at any time via Settings → Account → Delete Account. Upon termination, we will handle your personal data in accordance with our GDPR Notice and Privacy Policy.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Malta. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Maltese courts, without prejudice to your rights as a consumer under EU law.
For EU consumers, the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) is available as an alternative dispute resolution mechanism.
